Truck Accident Lawyers | Cross-Border Trucking
Serving Phoenix & Scottsdale, Arizona & Taking Cases Nationwide
The laws governing the trucking industry are complex. At our Phoenix Truck Accident Attorney Law Firm we handle all types of trucking accidents throughout the United States, including those involving Mexican trucks that cross into the U.S. and cause personal injury to others.
The U.S. federal and state governments set forth strict protocol on the loading, maintenance and operation of large trucks, However, Mexico has its own standards, which some feel are not high enough. The trucks themselves can be poorly maintained, even to dangerously unsafe levels. This makes them more likely to have mechanical breakdowns that can result in serious injury to drivers and passengers in other vehicles.
Injuries resulting from truck accidents can be severe, and can include spinal cord injury, brain injury, back, neck, and internal injuries that require lifetime medical care, living assistance, physical therapy and specialized medical equipment. Medical costs are therefore enormously high.
Federal Cross-Border Trucking Program
There is an inspection program in place for monitoring cross-border trucks. However, there has been controversy over allowing Mexican trucks into the U.S., and some of the concerns have been, and still are:
- Do U.S. officials have enough oversight and controls for alcohol and drug testing of Mexican drivers?
- The Department of Transportation (DOT) has stated that Mexican urine tests must be processed in U.S. labs.
- How can we know how many hours a Mexican driver has been on the road without resting?
- The DOT has said Mexican drivers must keep logbooks which meet U.S. standards.
- What if the Mexican driver does not understand English?
- DOT Secretary Mary Peters has stated that Mexican drivers must be able to understand anything said to them by inspectors, and answer in English.
- How can we know if the Mexican driver is physically fit?
- The inspection program requires them to carry proof that they are medically fit for the job.
